Copyright and takedown

Last updated 8 October 2026

Draft. This page is written in plain language for the Freebies team. Have a Ghanaian lawyer review it, and fill in everything still marked to be supplied, before you rely on it.

Members post their own photographs of things they are giving away. Sometimes a photo belongs to someone else. If something on Freebies is yours and you did not agree to it being here, this page is how to get it taken down - and how to answer if your own listing is reported.

1. Reporting something that is yours

Send a notice to Copyright contact email — to be supplied. So that we can act on it rather than write back asking questions, include all of the following:

  • your name, postal address, telephone number and email address;
  • what the work is - the photograph, description or other material you own;
  • the exact Freebies address where it appears. The link in your browser's address bar on the item page is enough; “a bag listing in Accra” is not;
  • a statement that you believe in good faith that this use was not authorised by you, your agent, or the law;
  • a statement that the information in your notice is accurate, and - under penalty of perjury - that you are the owner or authorised to act for them;
  • your physical or electronic signature.

We aim to act within one working day. A listing that is taken down stops being visible to anyone, and the member is told what was removed and why.

2. Where to send it

Notices go to our designated agent:

  • Agent: Designated agent name — to be supplied
  • Email: Copyright contact email — to be supplied
  • Post: Postal address — to be supplied

A notice sent anywhere else - the report button on a listing, or our general support address - will be passed on, but it will be slower, and the report button does not collect the statements the law requires.

3. If your listing was taken down

If you took the photograph yourself, or you have permission, or you believe the material was removed by mistake, you can send a counter notice to the same address. Include:

  • your name, postal address, telephone number and email address;
  • what was removed and where it appeared before it was removed;
  • a statement, under penalty of perjury, that you believe it was removed by mistake or as a result of misidentification;
  • your consent to the jurisdiction of the courts of Ghana, and your agreement to accept service from the person who sent the notice;
  • your physical or electronic signature.

We will pass your counter notice to the person who complained. If they do not tell us they have started a court action, we may restore the listing between 10 and 14 working days later.

4. Members who keep doing it

An account that is the subject of repeated, valid copyright notices is closed. We count notices that stand - one that is withdrawn, or answered by a counter notice nobody follows up, does not count against anyone.

5. A warning about false notices

A takedown notice is a legal statement made under penalty of perjury. Sending one about a photograph that is not yours - to clear a listing that is competing with your own, for instance - can make you liable for the other member's costs and damages. We read notices, and we report ones sent in obvious bad faith.

6. This is not for anything else

Scams, harassment, unsafe items and things that should not be on Freebies at all go through the report button on the listing or the conversation, which reaches our moderators directly. See the terms of use for what is not allowed.
